1. General provisions

These Terms of Use govern the use of the website creativegroup.az and of the services provided by "CREATIVE GROUP" Məhdud Məsuliyyətli Cəmiyyəti (CREATIVE GROUP LLC, TIN 1703491471, registered address: AZ1005, Bakı ş., Səbail r., Badamdar qəs., Zeynalabdin Tağıyev küç. 12, mənzil 27; hereinafter — the "Company", "we").

By using the website you accept these Terms. If you do not agree with them, please do not use the website or the services.

2. Description of services

The Company provides services in the following areas:

• development of websites, web applications and e-commerce platforms;
• development of mobile and desktop software;
• hosting, domain registration and technical support;
• business communication solutions — including the setup of customer communication systems over WhatsApp Business, SMS and e-mail;
• SEO, digital marketing and content services.

The exact scope, timeline and price of each service are defined in the contract or the approved quotation agreed between the parties.

3. User obligations

• To provide accurate, complete and up-to-date information through the website forms;
• Not to submit requests on behalf of another person without their consent;
• Not to use the website for unlawful purposes, including distributing malware, sending automated bulk requests, harvesting data without authorisation or compromising the security of the system;
• To warrant that any content submitted does not infringe the rights of third parties.

In the event of a breach, the Company reserves the right to restrict the user's access to the website.

4. Payment and refunds

Services are paid for on the basis of an approved quotation or a contract. Online payments made through the website are processed by the Epoint payment system; card details are handled within the payment provider's infrastructure and are not stored by the Company.

Refund terms:

• Where work has not yet started, the payment is refunded in full within 10 business days of the request;
• Where work has started, the amount corresponding to the work already performed is deducted and the balance is refunded;
• Third-party services that have already been activated (hosting, domains) are non-refundable;
• Refund requests must be sent in writing to info@creativegroup.az.

5. Communication channels and WhatsApp

When you contact us or use our services, the Company may communicate with you via WhatsApp, SMS, e-mail and telephone. These channels are used to:

• respond to your enquiries and requests;
• provide information about orders, payments, delivery and technical support;
• agree and confirm details relating to the delivery of the service;
• and — only where you have given separate consent — inform you about new services and promotions.

Opt-out. You may opt out of any of these channels at any time: by sending the word "STOP" in the WhatsApp conversation, by using the unsubscribe link in our e-mails, or by writing to info@creativegroup.az. Opt-out requests are processed within 3 business days. After opting out, we may still send service messages that are strictly necessary for the performance of an existing contract.

The WhatsApp service is provided by WhatsApp Ireland Limited and is subject to that platform's own terms.

6. Personal data

The collection, processing and protection of personal data are described in our Privacy Policy. You may request deletion of your data through the Data Deletion page.

7. Intellectual property

The design, text, logo, graphics, source code and other materials on the website are owned by the Company or by the respective rights holders. Copying, distributing or using these materials for commercial purposes without the Company's written permission is prohibited.

Intellectual property rights in work produced for a client pass to the client, to the extent set out in the contract, once payment has been made in full.

8. Limitation of liability

The website and the services are provided "as is". The Company does not warrant that the website will operate without interruption or error. The Company is not liable for:

• interruptions caused by third-party providers (hosting, payment systems, telecom operators, WhatsApp);
• damage arising from incorrect or incomplete information supplied by the user;
• indirect damage, loss of profit or loss of data.

In all cases the Company's liability is limited to the amount actually paid for the relevant service.

9. Changes to the Terms

The Company reserves the right to amend these Terms unilaterally. The updated text takes effect from the moment it is published on this page, and the "Last updated" date at the bottom of the page is changed accordingly. Existing clients are additionally notified of material changes by e-mail. Continued use of the website after a change constitutes acceptance of the new Terms.

10. Governing law and dispute resolution

These Terms are governed by the legislation of the Republic of Azerbaijan. Disputes are settled primarily through negotiation. If no agreement is reached, the dispute is referred to the competent courts of the Republic of Azerbaijan.
